    Make your decision today on the ISSUES

    A poll done Tuesday through Thursday last week, released yesterday, shows a “whopping 36%” are undecided in the race for Supreme Court Justice. (Of those likely voters who have made up their mind, it was 40% for Ziegler and 23% for Clifford. But Ziegler supporters, don’t you dare stay home….)

    I continue to be shocked at the reaction to accusations thrown at Judge Ziegler and her 10 year exemplary record on the bench. The mention of Ziegler’s “ethical challenges…” has dripped off the tongue of media types and it makes me see red. As I said last week, it’s completely irresponsible and immoral to make very sketchy accusations before the election that can’t even be heard by the Judicial Commission until after the election. Grrrr.

    (Have you read Judge Ziegler’s response to those irresponsible accusations?)

    I can’t say it enough. This is a very critical election. With the retirement of Judge Wilcox (who has endorsed Judge Ziegler), the court is balanced – three conservatives and three liberals. Needless to say, the winner in today’s election will break that 3-3 tie in dramatic fashion.

    Mark Belling said it well last week. Attorney Clifford has succeeded in completely deflecting this election from the issues critical to the function of law in this state. I urge you to make your decision on the issues – and then to share the summary below with every friend and associate you can manage to run in to. Today. Early today.

    As Mark Belling wrote it, below are the REAL issues absolutely critical to today’s election.

    “CRIME. Ziegler is a former federal prosecutor with a strong law-and-order record in her years on the bench in Washington County. Clifford is an American Civil Liberties Union attorney with a long track record of defending bleeding heart causes and even aided a man who went to Iraq to serve as a human shield against American soldiers.

    “BUSINESS CLIMATE. Wisconsin businesses have been devastated by a set of court rulings that eliminate all caps on damage awards in lawsuits…. Clifford…. is endorsed by every major trial attorney in the state. Ziegler, on the other hand, has openly courted business groups.

    “SCHOOL CHOICE. The Supreme Court has already upheld the legality of the wildly successful Milwaukee program that gets kids out of lousy public schools. Clifford has talked openly about "revisiting" the case. Her rhetoric is intentional. She’s sending a message to the teachers union [the union and members are very generous supporters of Clifford’s campaign] and other liberal groups that numerous cases decided by the court could be reopened and reversed.

    “JUDICIAL ACTIVISM. Ziegler has made it clear she does not believe in "legislating" from the bench and will not…usurp the power of elected officials. Clifford, on the other hand, has said in an interview she considers the Constitution to be a "breathing" document. [Clifford calls her approach to judging “pragmatic.”] That’s the word liberals use to rationalize saying the Constitution says whatever they want it to say.”


    Vote today. Vote responsibly. Vote for experience – and vote – on the issues.

    Hurray! Judge Ziegler won! I think Ziegler's campaign did an adequate job of handling the attacks (unlike another campaign I was close to, that one took the attacks with a deer in the headlights approach). Not only that, they refused to passively take the darts and pulled some of their own out. Due to her lack of credentials Clifford had no choice but to go on the attack. I can not recall hearing one Clifford ad talking about why she should get the job instead I heard why Judge Ziegler should not get the job. Whereas with Judge Ziegler I did not hear too much being said about Linda Clifford until later in the race.
    Indeed Mark - hear hear! Good mini-analysis. Rather than deer-in-the-headlights, response to attacks perhaps should be immediate, but measured, professional, demure. JE
